SWIMFIT TERMS & CONDITIONS:

Overview

Welcome to Swimfit. These Terms & Conditions govern your participation in our swimming programmes and services. By enrolling in any Swimfit class or programme, you acknowledge that you have read, understood, and agree to be bound by these terms. For participants under 18, parents or legal guardians must accept these terms on their behalf.

1. Registration & Class Booking

Swimfit offers swimming classes through our online booking system available at www.swimfit.hk. Class availability is allocated on a first-come, first-served basis.

Returning Students: Existing participants receive priority booking for subsequent terms, provided they confirm their enrolment by the specified deadline. Places not confirmed by this deadline may become available for new students.

Priority System: Group classes are given priority in our scheduling and allocation system compared to private or semi-private instruction.

Booking Confirmation: Upon successful registration, an automated confirmation email will be sent to the email address provided. Should you not receive this confirmation within seven days, please reach out to us at swimfit.hk@gmail.com.

2. Payment Terms & Billing

Billing Through Partner Venues

When you enrol through a participating venue partner, your account will be billed monthly in accordance with that venue’s standard billing procedures and schedule.

Direct Payment with Swimfit

Participants enrolling directly with Swimfit are required to settle payment before classes commence.

– Swimfit will issue an invoice via email detailing your programme fees

– Your enrolment is considered active only upon receipt of full payment

– A receipt will be issued for your records—retain this as proof of transaction

– If payment remains outstanding, Swimfit may restrict access to classes and cancel your enrolment

– All outstanding balances remain due regardless of enrolment status

3. Absence & Non-Attendance

Absence from scheduled classes—whether due to illness, personal commitments, holidays, or any other reason—does not entitle you to refunds, credits, or alternative sessions. You remain responsible for all fees for classes within your enrolment period, whether attended or not.

4. Programme Modifications & Facility Closures

Swimfit may cancel or modify classes due to:

– Severe weather conditions (Typhoon Signal 3 or higher, rainstorm warnings)

– Unsafe swimming conditions or water contamination

– Facility emergencies or maintenance requirements

– Government-mandated closures or public health directives

– Other circumstances beyond Swimfit’s reasonable control

Weather-Related Cancellations: When Swimfit initiates a cancellation due to adverse weather, we will notify participants via email, SMS, or WhatsApp with at least one hour’s advance notice where possible. Cancelled classes will result in either a full refund or credit toward future sessions.

Outdoor Venue Adjustments: For outdoor pools, Swimfit may issue a class credit if cancellation occurs prior to the scheduled start time. Once a class has commenced, it is considered complete, and no credits will be issued regardless of subsequent weather deterioration.

Transport & Other Interruptions: No refunds or credits will be provided for cancellations related to public transport disruptions, emergencies, or other external circumstances beyond Swimfit’s control.

5. Private & Semi-Private Lesson Cancellation Policy

Participants wishing to cancel a booked private or semi-private lesson must provide notice as follows:

Short Notice Cancellations (Less than 24 hours): The full lesson fee is charged.

Adequate Notice (24 hours or more): An administration fee applies based on lesson duration:

– 30-minute lesson: $200

– 45-minute lesson: $300

– 60-minute class: $400

Term Termination: To discontinue private lesson arrangements mid-term, provide two weeks’ written notice or pay an equivalent termination fee.

Excessive Cancellations: Should more than 50% of your scheduled classes be cancelled during a term, Swimfit reserves the right to charge full fees for all remaining scheduled sessions.

Mid-Term Enrolment: Participants joining after a term has commenced may be subject to pro-rata pricing based on remaining sessions and availability.

6. Group Class Withdrawal

Should you wish to withdraw from a group class programme, one month’s written notice (or payment equivalent) is required.

**Medical Exceptions:** Withdrawal requests supported by medical documentation (serious illness or permanent incapacity) may be processed with shorter notice periods at Swimfit’s discretion.

7. Safety, Conduct & Facility Rules

Health Requirements:

– Do not attend classes if you have contagious illnesses, infections, open wounds, or any condition that could endanger others

– Disclose all relevant medical conditions, allergies, and health concerns prior to commencement

– Notify Swimfit immediately of any health changes that may impact your safe participation

Supervision & Conduct:

– Children must remain under direct adult supervision at all times

– Attending adults are responsible for monitoring children in changing areas and poolside

– All participants must adhere to instructor guidance and venue regulations

– Swimfit reserves the right to suspend or terminate participation for unsafe, disruptive, or inappropriate behaviour

Prohibited Activities:

– Recording or photography of other participants is not permitted without explicit consent

Liability:

– Participants assume responsibility for any loss, damage, or injury resulting from their own actions or those of children under their supervision

8. Health & Fitness Acknowledgment

By registering for Swimfit programmes, you confirm:

– You possess the physical fitness necessary for safe swimming participation

– You have disclosed all relevant medical information, allergies, and health conditions to Swimfit

– You understand swimming involves inherent physical risks

– You accept responsibility for your own (or your child’s) medical suitability to participate

9. Photography, Media & Data Privacy

Swimfit may photograph or record participants during classes for internal and promotional purposes. Personal information collected through registration will be used for programme administration, communication, and service improvements in accordance with data protection regulations applicable in Hong Kong.

10. Assumption of Risk & Limitation of Liability

Swimming and aquatic activities carry inherent risks of injury or harm. By enrolling in Swimfit programmes:

– You acknowledge and accept these inherent risks

– You commit to following all safety instructions from Swimfit instructors and venue personnel

– You release Swimfit from liability for injury, loss, or damage arising from class participation or facility use, *except where Hong Kong law prohibits such exemption*

– Nothing herein excludes Swimfit’s liability for death or serious injury caused by gross negligence

11. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the jurisdiction of Hong Kong courts.

Acceptance of Terms

Your enrolment in Swimfit programmes constitutes your acceptance of these Terms & Conditions in their entirety. You acknowledge that you have had the opportunity to review these terms, understand your rights and obligations, and accept them voluntarily on behalf of yourself and/or any children under your legal guardianship.
